Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. On behalf of all legal immigrants I want to congratulate President Obama for taking on Immigration Reform, as he promised during his campaign. As he embarks on this endeavor, we would like to urge the President to listen to the over 2/3 of Americans who favor immigration reform, and not to the small yet vociferous nativist anti-immigration groups that flood Congress with phone calls and faxes. over two thirds of 300 million Americans cannot be held hostage by a few hundred angry nativists.

Any ideas or suggessions on why EB2 priority dates dint move forward even this month? As per earlier discussions the VISA numbers are now getting released every 3 months instead of every year. So we should have seen some movement every 3 months. But since October'06 it has only advanced twice once in Nov'06 by 6 months and then in Dec'06 by 7 days and after that it seems to have got stuck at 8th Jan 03 . New numbers were supposed to be released in January. But no idea what happened and it's stuck there.
Any of you have any idea on this ?

Folks, here are some lobbying and action items that will be very useful.
1) Try reaching out to your American friends/managers/colleagues and ask them to call Senators.
2) Universities are missing in action here. They are major beneficiaries of high-skilled immigration, because graduate school is typical first step. They must be concerned with not only the fact that special categories for researchers/professors is gone but also that lot fewer students from India and China will labor in their labs. COUNCIL OF GRADUATE EDUCATION is a good place to start.
3) Someone please write and op-ed piece of NY Times. They are pretty sympathetic to these kind of issues. A major criteria for publication in the op-ed section is that the topic should be current. The plight of legal immigrants can't get more current that this. Any op-ed piece will get major exposure to our plight. The op-ed should not be complaining in tone, but rather show the value of having a proper high-skilled immigration reform for the American economy.

I am involved myself in a mess regardning the Green Card labor process
1) I had appplied for RIR labor in Apr 2004 and it was sitting in the Backlog elimination center (BEC)
2) In November 2006 I filed a conversion case and reapplied in PERM on my own while retaining priority date of april 2004.
3) Just last week I got a denial letter from DOL stating the reason
"The employer has not indicated on the application that applicants with any suitable combination training or experience are acceptable. the ETA form 9089 indicates the alien is currently employed by petioning employer and only qualifies for position identified in the application by virtue of the employers alternative experience requirement"
also the letter said
The job requirements did not exactly match the earlier case and hence priority date cannot be maintained
This denial also caused the automatic withdrawal of my earlier backlog case.
4) The priority date was very impt to me since I applied in EB3 and from India.
Is there anything I can do to maintain my priority date. I am also ready to forego the PERM application completely if only I could reinstate the earlier BEC labor case and just wait it out. I understand I commited a blunder by taking the risk of re filing in PERM while maintaining priority date...I feel i am losing almost 3 yrs of wait time and will be relegated to the back of the queue if I refile again

Should the job title for PERM labor filing be in Job Zone 5 to qualify under EB2 category? Or could one apply in Job Zone 4 and still qualify for a EB2? Also, does having an MBA, exempt a person from EB quota under any of the proposed bills like STEM, SKIL, PACE, TALENT or should it have to be an MS in Engineering.
A quick response would be greatly appreciated.
Not sure about the first question. SKIL bill will exempt any advanced degree from US or Advanced degree in STEM from outside + 3 Years. PACE, TALENT and the current CIR only exempt STEM Advanced degree + 3 Yrs

Hi All,
I have an approved I-140 from an employer X. I-140 was approved 2 years ago. And last year I left X company and took a full time position. Since X is my frined he did not mind leaving his company at that time.
I applied for 485 in July as a future employee for X using that approved I-140. I got EAD and AP also.
Now we got into some money issues and he wants to revoke my I-140/I485?
Can he do that?
Please advice.

I believe what you need to show is the company's P&L statement with revenue statement, and not just $7000 in profit. if the company has a revenue of $1mil or more, it should be fine, if less then it needs to show how many employees it had and what profit or loss it made....it should be at least $1.0 profit, rather than a loss.

You need to have PT license to work. Every state has different rules, there is lot of paper work involved to sit for license exam. For Indians, mostly it was easy for Michigan, New york. For present scenario better check physicaltherapyforum.com, very good info avaliable

I have labor pending from a State A, now my employer is asking me to move to State B. However, my employer is willing to keep alive, labor process from State A and is also ready to file new labor from State B. Question is if labor A gets approved and if I apply I-140 on that labor, do I have to reapply I-140 for labor B, once labor B gets approved or I can use the same I-140?
Help is appreciated.

Whether it is LCA for H1 or PERM labor for GC it is location specific, unless one filed(or able to file) AC21 after July '07 fiasco, you need to have labor to a specific job to the specific location you will be working.
Either job or the location changes you need to start allover again, in some cases you can recapture (or port) your priority date.
