    Looks like AGjOBS bill has good chance of passing. Does anyone know what the definition of agricultural worker is ?
    Could one by considered agricultural worker if they are in landscaping business ? what about in agricultural sales.
    We are about to see creation of huge black market for documents claiming someone is farmer if this rule is passed.

    Can one be illegally working as Ag worker while on H1 ? :)

    Is there any risk in rescheduling a fingerprinting appt? I am travelling when the appointment is currently scheduled for:(. Does that impact the overall processing times of 485/EAD/AP?

    I don't know how it affects the overall processing times, but there is no problem rescheduling the appointment. Just follow the instructions on your notice.

    1 disclaimer - you MUST reschedule it before your original appointment date. Failure to attend your appointment without 1st rescheduling is considered an abandonment of your AOS etc.

    My AP was approved while my wife's it was denied with reason "there is no pending I-485". My PD is 22 Nov 05 which is not yet current so I don't understand why they denied derivative spouses petition while mine was approved. We had an interview back in January and everything went on well there. Did anyone have similar issue? What are my options? I do not want to spend money and file for motion to reopen.

    USCIS - Change of Address Information (http://www.uscis.gov/addresschange)

    Penalties for Failure to Comply

    A willful failure to give written notice to the USCIS of a change of address within 10 days of moving to the new address is a misdemeanor crime. If convicted, you (or parent or legal guardian of an alien under age 14 who is required to give notice) can be fined up to $200 or imprisoned up to 30 days, or both. The alien may also be subject to removal from the United States. (INA � 266(b)). Compliance with the requirement to notify the USCIS of any address changes is also a condition of your stay in the United States. Failure to comply could also jeopardize your ability to obtain a future visa or other immigration benefit.

    My application date July 2 /2007
    Notice date Aug 22 /2007
    Mine is NSC to CSC
    Till today No FP

    Finally today Mar 18 I got a mail saying

    Application Type: I140 , IMMIGRANT PETITION FOR ALIEN WORKER

    Current Status: Case Transfered to Another Office for Processing


    So now on what basis date, RD Aug 22 or transfer date Mar 18 they will touch my case .How long will it take ? Any body on same boat.....

    I moved to US in 1987 got a 2 year conditional residence green card sponsored by my step father. Once the 2 years were met the new forms were submitted but I believe were a couple of days late. At the time I was 19. I remember vaguely remember it but we took the paperwork into the office.
    So I waited and waited at an address shared with 2 college roommates and no new green card came. I thought maybe it came and someone had mistakenly through it away. No notice was sent to my mother's house for me to leave.
    Well I never really bothered with it till more recently. I didn't work I had ID so other than violating the fact I didn't "carry" my green card everywhere I went, I thought i was perfectly legal.
    In 1993 my mother passed away(still married to stepfather).
    So about six months ago I decided to file an I-90 for a new card because I wanted to travel out of the US. They sent me an appointment for biometrics. I went to that and figured it was a done deal. Then they sent me a card that expired in 1989, explaining that I had filed the wrong form and needed to file like the I-751. Also they let me know that they would keep the fees for the wrong filing(the least of my worries).
    So I briefly looked over this I-751 and basically I think I have to prove that my mother was married to my stepfather for the required time. First I barely remember his name, have no idea where they were married. Just looking for some help on this situation. Not really sure what to do.
    I have an appointment on Monday with an immigration attorney. They ran my alien number for me and no action of deportation has been started. So I guess that is a good sign.
    I have been here almost 21 years now and I like it here I want to stay :P
    I'm from England btw not that this is a big deal just thought I would mention it.

    Make sure you do not travel out of USA before you get your approved AP, since as per the law if the person who filled I485 leaves the country without AP then it is considered that he abandoned his I485, with the exception given to H1B/H4 and L1/L2 (and youdont have any of these)

    If you leave USA without AP then you need to restart the process, if you have AP then that is all you need to travel.

    Can we ask for a new legislation that will allow for complete portabilty after i-140 approval? If this is achieved I don't think retrogression/insufficient Visa#'s would be a big deal.

    Hi,

    I will be going for H1B stamping in feb/March at Mumbai Consulate.
    In 2001 my F1 visa got rejected 3 times because I showed that I have sister in USA.

    My sister is in still in USA. Now while taking H1B appointment in form I have again to mention yes or no (for the Que do you have any relatives in USA)
    What I should do? What will be the effect if I said No? Do you think, VO will ask me that your F1 got rejected because you had sister in USA? So now did she came back?

    Please reply me ASAP.

    As far as i know no us consulate has right to reject H1b unless u have fasle docs or involved in wrong activities. Also DO NOT GIVE/WRITE any FALSE information about you to them or in other words DO NOT LIE to them .

    F1 rejection has NO baring on H1b.

    For stamping you should not need pay stubs to prove your staus. Uninterrupted pay stubs are very important for change of status when you are applying while in US. When you leave US you dont have a status, the visa officer should not base his decision on the continuity of pay stubs. I went through a very similar situation, my change of satus was denied even though I was on genuine unpaid leave. However I ended up leaving the country and getting H1B stamped in India with no problems.

    1. March 31 , 2008 - I am on H4 with I-94=12345..
    2. June 27,2008 - H1 got approved with i-94=12345.. valid from 10/1/2008-9/23/2011.
    3. Sep 10, 2008 - I enter US on h4 with i-94=abcdef.....

    4. Oct 1 , 2008 - Ideally (as confirmed by USCIS, immigration lawyer) , I-94=12345.. should have been in system (become active) and status changed to H1.
    But it didn't happen and I-94=abcdef... is active.

    Questions:
    1. What is my status from Oct 1, 2008 - Dec 31, 2008? H1 or H4.
    Since my h1 status was not in system, i didn't get any SSN & hence no paystubs.

    2. What is the safest & quickest way to get my h1 status active in system..

    a) Stamping in Canada - Quickest for me. Is it safe ?
    b) Get status changed without getting out of country? - But how?
    c) Stamping from Home country? -- Last option.

    Any help will be appreciated.

    I guess we should ask them to remove the employer's restriction, which is the prime reason for extreme exploitation. H1b should not be restricitive. IV should also address the same. We are looking at the current problem with retrogression only, but what about future aspirants who come on H1.


    H1B quota and H1B related issues are not primary concern of this organization. Greencard retrogression is. It has been that way since the inception 18 months ago.

    We have taken positions to make H1B more workable and have less restrictions on it regarding H1 extensions and H1 transfers and therby opposed major portions of Durbin-Grassley.

    HOwever, right now is not the time to debate and have open discussion on flaws of H1B program.

    This is distraction at minimum and ammo for anti-groups in worst case scenario. Please contribute, send webfaxes, make phones and provide live updates and save this discussion on H1B flaws for slower times.
