My application for an H1B change of status has been denied. I am an F-1 student from Colombia and I was offered a job from THe CDC at Atlanta. According with the USCIS report, the petition was denied because I am going to be hired for a staffing company and not directly for the CDC. It will be possible to appeal the desicion ? If yes, what will my sponsor company need to be succesful with this appealing ?

Mail it in, if it's rejected you do not lose anything. According to the law (8 USC 1255) the USCIS should accept it.
Not according to this:
8 1255. Adjustment of status of nonimmigrant to that of person admitted for permanent residence.
(a) Status as person admitted for permanent residence on application and eligibility for immigrant visa
The status of an alien who was inspected and admitted or paroled into the United States may be adjusted by the Attorney General, in his discretion and under such regulations as he may prescribe, to that of an alien lawfully admitted for permanent residence if
(1) the alien makes an application for such adjustment,
(2) the alien is eligible to receive an immigrant visa and is admissible to the United States for permanent residence, and
(3) an immigrant visa is immediately available to him at the time his application is filed.
Not according to this:

A hypothetical, but important debate on worst case scenario in changing job using AC21

Assume changing jobs using AC21 has some risk, debate is what is that risk. I am not expecting response like pack up and leave back to home country as I already know that. I am interested serious debate from people who used AC21 and bought houses and simulated in American culture and have family reasons to stay in US.
Lets assume USCIS send some RFE and rejected 485 that new job was not same or similar. Now -
a) How many days I have to leave country ?
b) After the rejection of adjustment of status how many days I have to wrap up my current job or I must leave it same day when rejection letter received from USCIS ?
b) After those number of days can one acquire visitor's visa for up to six months to pack up stuff, house and family on the ground of rejection of adjustment of status?
c) Can one change status to some non immigrant visa such as new H-1B or F-1 by traveling back and reentering to USA ?
d) After the rejection of adjustment of status can one still port priority date in a new green card processing ?
f) I am also interested to hear feedback on what one can do to mitigate the risk of Ac21(I already know that use attorney's advise when changing job or donot change the job)

I have labor pending from a State A, now my employer is asking me to move to State B. However, my employer is willing to keep alive, labor process from State A and is also ready to file new labor from State B. Question is if labor A gets approved and if I apply I-140 on that labor, do I have to reapply I-140 for labor B, once labor B gets approved or I can use the same I-140?
Help is appreciated.

Whether it is LCA for H1 or PERM labor for GC it is location specific, unless one filed(or able to file) AC21 after July '07 fiasco, you need to have labor to a specific job to the specific location you will be working.
Either job or the location changes you need to start allover again, in some cases you can recapture (or port) your priority date.

I am a labour substitution case pd feb 2002 filed 140 in June at NSC. My 140 has been pending for more than a year. Now recently I received 2 year ead.
Does this imply my 140 is approved too???

I do not understand why they grant EADs when your I-140 is not approved. The reason I bring this up is if a person loses his/her job and your I-140 is revoked, the EAD is useless. You cannot use AC21 for that because your I-140 is not approved.
Nebraska center is doing nothing regarding I-140 EB-3 (India) apps. The I-140 date at Nebraska has beeing moving by 1 day per month for the last 7-8 months. It is stuck at March 30th 2007. Moreover, the latest "as of" i.e. "report" date that you see on Nebraska is July 31st 2008. It is not current (Sept 2008) as many of you may think.
I understand that they receive 1000s of applications but that is no excuse for incompetence. As of July 31st, it was taking them 1 year and 4 months and now it is 1 year and 6 months to process I-140.

Did you get the finger Print Notice?

I was in a similar situation as you and had to use this firm. H1B filing experience was fine but the entire GC process and filing was not a good experience at all. There were days I had to call the paralegal and teach him the new immigration laws and that's never a good sign ! Because of their mistake I was stuck in Eb3 rather being in Eb2. May be they will deal differently with your case but have a chat with them and your company managers before you agree to use them. I m with another company and another attorney firm and they are awesome !

I am currently on H4 and it expires in a couple of months. I have my H1 approved for 2008 quota. My husband's H1 expires on sept 2007. we are applying for I-485 next month. Do i need to apply I-765 and I-131 because as per the instructions from my attorney it says the following:
-I-765 or EAD card. If you have valid H-1B valid more than one year and will not change job, you do not need EAD.
-i-131 or Advance Parole. If you have valid H-1 or H-4 visa stamping valid more than one year of if you are Canadian citizen, you do not need AP
Please clarify me whether I-765 and I-131 is required for our case.

My wife'e H1B expires on Feb 2007 and she still has not applied for H1B renewal as she was on maternity leave. She will do so in first week of November. It looks like H1B extension process takes more than 3 months. Virginia is one of the states which just gives ur Driver license till ur H1B validity. So her license is valid till feb 2007. Would like to know if she can get her license renewed in Feb 2007 with a H1b receipt number or should she do Premium processing of her H1B. Any help is greatly appreciated.

How ever call Identity Services (dont remember the division's name exactly) @ 804 367 0064 and explain your situation. They are the folks that generally issue a letter for H4 visa holders who do not have a I 797. They will take atleast 1 month to send the letter once they decide to do it. Start acting now! Good luck.

I think you should apply for H1 extensions about 6 months in advance even if u have applied for AOS. Your driver license might also expire with your H1-b and to renew your license you will need approved H1-Extension. Also just in case something goes wrong with your AOS application and it gets denied, you might be out of status.
I would strongly suggest that you apply for H1-Extension well in advance just to be on safe side.
